Inquest resumes into death of man in garda custody



A garda sergeant has told an inquest that any injuries received to the late Dwayne Foster during his arrest were unintentional.

The 24-year-old from Woodbank Avenue, Finglas was discovered unresponsive in Coolock Garda station on March 7, 2006 and was pronounced dead at Beaumont Hospital some time later.

He was being questioned over the fatal shooting of Dublin mother, Donna Clery at a house party in Coolock.

The Coroner's Court has heard Mr Foster resisted arrest as gardaĆ­ swooped on a house in Co Kildare on March 5, 2006.

He was held face down and handcuffed.

Two days later he was discovered unconscious in a garda cell...A post mortem by Deputy State Pathologist Dr Michael Curtis found he died of methadone intoxication,

He also found 34 injuries on his body. In his evidence today Det Sgt Cormac Brennan has not disputed that some of the injuries may have been the result of a forcible arrest.

However he denies kneeling on the suspect, causing an injury to his right hand and that unreasonable force was used.

The inquest resumed today after a six-month adjournment.
